These Terms govern your use of exams.design ("the Service"), operated by Mohamed Masoud, 01237 Dresden, Germany ("we", "us"). By using the Service, you agree to these Terms.
exams.design provides a web-based exam creation tool with both manual building features and AI-powered exam generation. The manual builder is available for free with limitations. AI generation and premium features require credits or a Pro subscription.
To use AI features and save exams, you must create an account with a valid email address. You are responsible for maintaining the security of your account. You must be at least 16 years old to use this Service.
The free plan includes limited access to the manual exam builder (max 3 sections, 30 questions), 5 one-time AI credits, and advertisements. Exams printed on the free plan include a "Made with exams.design" watermark.
The Pro plan is an annual subscription providing unlimited builder access, no ads, no watermark, PDF export, answer keys, bubble sheets, and 10 AI credits per year. The subscription auto-renews annually unless cancelled.
AI credits can be purchased in packs. Each credit allows one AI exam generation. Credits do not expire and are non-refundable once used.
All payments are processed by Stripe. Prices are in Euros (EUR) and include applicable taxes.
Pro Plan: You may cancel at any time. Cancellation takes effect at the end of the current billing period. No partial refunds for unused time. You can manage your subscription via the billing portal in your account.
Credit Packs: One-time purchases. Unused credits are non-refundable. We may offer refunds at our discretion for unused credits within 14 days of purchase per EU consumer rights (Widerrufsrecht).
Right of Withdrawal (Widerrufsrecht): As a consumer within the EU, you have a 14-day right of withdrawal for digital purchases. By using an AI credit, you consent to the immediate provision of the digital service and acknowledge the loss of your right of withdrawal for that credit.

Your Content: You retain full ownership of all exam content you create. We claim no rights to your exams, questions, or uploaded materials.
AI-Generated Content: Exams generated by AI are provided for your use. You are responsible for reviewing AI-generated content for accuracy before use in educational settings.
Our Service: The exams.design platform, its design, code, and branding are our property and protected by copyright.
AI-generated exams are created by artificial intelligence and may contain errors, inaccuracies, or inappropriate content. We strongly recommend reviewing all AI-generated content before use. We are not responsible for the accuracy of AI-generated questions or answers.
We process personal data in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR/DSGVO).
The Service is provided "as is" without warranty. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
This limitation does not apply to damages caused by intentional misconduct or gross negligence, or to liability that cannot be excluded under German law.
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We are not liable for downtime.
We may update these Terms. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the Federal Republic of Germany. For consumers within the EU, mandatory consumer protection laws of your country of residence apply.
Place of jurisdiction for merchants: Dresden, Germany.
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
